How renewal notice deadlines work
Most commercial lease renewal options require written notice within a specific window — typically "no less than 9 and no more than 12 months prior to the expiration of the Term." Two dates matter:
- The deadline (latest notice date): expiration minus the minimum notice period. Miss it and the option usually lapses automatically — no grace, no cure.
- The window opening (earliest notice date), if your clause has a "no earlier than" limit: notice given too early can be invalid too.
Why missed notice windows are so expensive
A lapsed renewal option transfers leverage instantly. A tenant loses a below-market renewal rate and negotiates from zero; a landlord expecting a vacancy loses a year of planning. It is the single most expensive blank cell in lease administration — and it's entirely preventable with a tracked date.
